Colorado has enacted landmark legislation aimed at formalizing the end-of-life management for electric vehicle (EV) batteries. Senate Bill 26-003, signed into law by Governor Jared Polis on June 4, establishes a comprehensive regulatory framework for large-format propulsion batteries, marking a significant milestone for the U.S. battery recycling industry. The new law introduces the nation’s first mandatory critical mineral recovery targets for EVs, potentially setting a precedent for similar policies across other states.


Defining Recovery and Responsibility

The legislation establishes a clear management hierarchy that prioritizes the repurposing of EV batteries before they enter the recycling stream. A pivotal component of the act is its precise definition of a “recycler.”

To qualify as a recycler, an entity must perform actual extraction, separation, or refining of materials. This requirement effectively excludes simple collection or transportation operations.

The law mandates high-level traceability through detailed labeling on battery packs. These labels must include information on cathode chemistry, energy density, and manufacturer responsibility. This transparency assists secondary handlers, such as remanufacturers and repair shops. It ensures they safely manage stranded batteries and route them to qualified facilities for material recovery.


Mandatory Critical Mineral Targets

Perhaps the most ambitious aspect of the law is the introduction of per-mineral recovery targets for lithium, cobalt, and nickel. Unlike aggregate standards that might favor heavy metals, these specific benchmarks ensure that lithium recovery is not overlooked.

The mandate scales over time:

By 2031: Minimum 90% recovery rate for cobalt and nickel, and 50% for lithium.

By 2035, lithium recovery requirements will increase to 80%. Meanwhile, cobalt and nickel targets will remain steady at 90%. Furthermore, industry stakeholders—including major recyclers like Cirba Solutions and Redwood Materials—actively participated in the bill’s development. They aimed to ensure the framework remains flexible enough to accommodate evolving battery chemistries, such as lithium-iron-phosphate (LFP) and sodium-ion technologies.
